Senator Reynolds is suing the pair over alleged defamation in a series of social media posts. In her first public appearance in Australia since the pair moved to France last year, Ms Higgins told the waiting media pack that Perth was a beautiful, but difficult place to come back to, and she believed "everyone's acting in good faith". Senator Reynolds arrived shortly afterwards but said she would reserve her comments until after the mediation. It's alleged Ms Higgins breached a non-disparagement clause in a settlement contract she entered in , which prohibited her from speaking negatively about Ms Reynolds. Ms Reynolds is seeking aggravated damages, an injunction preventing Ms Higgins from publishing defamatory material, and another injunction to stop her from breaching the settlement contract. She has separately accused Ms Higgins's partner, David Sharaz, of defaming her in five social media posts, which were allegedly "falsely defamatory" and caused her "loss and damage". The Perth-based senator first threatened legal action in July last year, claiming she had been the "target of unwarranted criticism and abuse" since Ms Higgins made her rape allegations public. Ms Higgins alleged she was raped by a colleague, Bruce Lehrmann, while she was working in Ms Reynolds's Canberra ministerial office. Mr Lehrmann's criminal trial was abandoned in October following juror misconduct and a planned retrial was later dropped by the prosecution. Justice Marcus Solomon has overseen the defamation action since it emerged last year. In August, he implored both parties to explore means of resolving the dispute without a trial, expressing concern for the "human cost of litigation".

Higgins told police she had already undertaken media interviews. This strategy by Ms Higgins significantly hindered the investigation as it was also extremely difficult for investigators to progress the investigation without a statement of complaint. Moller urged Higgins not to speak to the media on several occasions during the investigation. Lehrmann, who pleaded not guilty to one count of sexual intercourse without consent, has always denied the allegation of rape and no findings have been made against him. He was tried in the ACT supreme court last year but a mistrial was declared after juror misconduct. Much of the independent inquiry, before former Queensland solicitor general Walter Sofronoff, has focused on tensions between police and the director of public prosecutions over the decision to charge Lehrmann.
